Terms of Service

These Terms of Service ("Terms") govern your use of the Fitty Up mobile application and related services. By downloading, accessing, or using Fitty Up, you agree to these Terms.
1. Operator and Scope
Fitty Up is operated by Chattrawut Phoolakorn ("Fitty Up," "we," "our," or "us"), an individual developer based in Thailand. These Terms apply to your use of the mobile app, in-app purchases, AI features, support tools, and related services we make available.
2. Eligibility and Accounts
You must be at least 13 years old to use Fitty Up. If you are under the age of legal majority where you live, you may use Fitty Up only with permission from a parent or legal guardian.
- You must provide accurate information and keep your account credentials secure.
- You are responsible for activity that occurs under your account.
- You may not impersonate another person, create accounts for abuse, or try to bypass account, credit, or subscription limits.
- We may suspend or terminate accounts that violate these Terms, applicable law, or third-party platform rules.
3. Fitty Up Services
Fitty Up is a wellness and fitness application that may include, depending on your plan and region:
- Nutrition logging, food databases, meal photos, and macro or calorie tracking.
- Workout logging, route tracking, analytics, body measurements, and progress reviews.
- AI-powered food analysis, chat assistance, summaries, and planning tools.
- Courses, reminders, health integrations, body progress features, subscriptions, credits, promotions, and referrals.
Features, limits, models, and availability may change over time, and some features are only available on certain devices, platforms, or paid tiers.
4. Health, Fitness, and AI Disclaimer
Fitty Up is provided for general wellness, education, and self-tracking purposes only. It does not provide medical care, diagnosis, treatment, or emergency services.
- Nutrition estimates, AI suggestions, workout recommendations, and progress analysis may be incomplete or inaccurate.
- AI-generated tool actions, plans, or suggested changes should be reviewed before you accept or apply them. Where Fitty Up asks for confirmation, you are responsible for confirming only actions you understand and want to perform.
- You should consult a qualified professional before making significant health, nutrition, medication, or exercise decisions.
- You are responsible for listening to your body, training safely, and stopping activity if you feel pain, dizziness, or other warning signs.
- Do not rely on Fitty Up or any AI output for emergencies. Contact local emergency services or a qualified clinician when needed.
5. Subscriptions, Credits, Top-Ups, and Promotions
5.1 Plans and billing
Fitty Up may offer free and paid tiers, subscriptions, and one-time digital purchases such as credit top-ups. Prices, billing periods, and included features are displayed in the app or the app store at the time of purchase.
5.2 App store billing
Subscriptions and in-app purchases are processed through Apple App Store or Google Play, with entitlement management handled through RevenueCat. Your store account, not Fitty Up, processes your payment method. Auto-renewing subscriptions continue until canceled under the rules of the applicable store.
5.3 Cancellation, trials, and refunds
You can cancel an auto-renewing subscription through your Apple or Google account settings. If a free trial, introductory offer, or promotional price is shown at checkout, that offer is governed by the store terms shown there. Refunds are handled by the applicable store except where law requires otherwise.
5.4 Credits and top-ups
- Included subscription credits and bonus credits may refresh, expire, or reset on the schedule shown in the app.
- One-time top-up credits are digital consumables, are not redeemable for cash, and are generally non-refundable except where required by law or store policy.
- Purchased top-up credits currently do not expire while your account remains active, but they are forfeited if your account is deleted or terminated.
- Optional rewarded ads may grant bonus credits subject to availability, daily limits, anti-abuse rules, and successful verification.
- We may reverse, withhold, or cancel credits obtained through fraud, abuse, chargebacks, exploits, or store/payment failures.
- We may use anti-abuse, replay-prevention, and verification controls for purchases, refunds, rewarded ads, referrals, and credit grants.
5.5 Promotions and referrals
Promotional offers, referral programs, and bonus-credit campaigns may be changed, limited, suspended, or canceled at any time. We may reject or reverse rewards where we reasonably suspect abuse, self-referrals, fraud, or violations of these Terms.
6. Acceptable Use
You agree not to:
- Use Fitty Up for unlawful, harmful, infringing, or fraudulent purposes.
- Upload malware, malicious code, or content designed to break, probe, scrape, or overload the service.
- Try to bypass subscriptions, credit rules, rate limits, or security controls.
- Manipulate, replay, forge, or abuse purchase, refund, rewarded-ad, referral, webhook, or credit-verification flows.
- Reverse engineer or attempt to extract source code except where law cannot prohibit that activity.
- Upload content you do not have the right to use, or that violates another person's privacy, publicity, or intellectual-property rights.
- Upload highly sensitive documents, payment-card data, government identifiers, or other confidential materials to features not intended for that purpose.
- Submit URLs, media, prompts, or attachments designed to access private networks, exfiltrate data, track other users without consent, or interfere with Fitty Up's systems.
- Use AI features to generate abusive, deceptive, harassing, or unsafe content, or to submit harmful prompts or attachments.
7. User Content
You retain ownership of content you submit to Fitty Up. You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, adapt, transmit, and display that content only as needed to operate, secure, improve, and support Fitty Up. This includes sending content to service providers that help us provide storage, AI processing, notifications, diagnostics, and payments.
- You are responsible for the legality, accuracy, and appropriateness of what you upload.
- You represent that you have all rights needed to submit your content and grant the license above.
- We may remove, restrict, sanitize, or decline to render content, links, or media that violates these Terms or creates legal, privacy, security, or safety risk.
8. Third-Party Services and Platforms
Fitty Up depends on third-party services and platforms, including Apple, Google, Supabase, RevenueCat, Anthropic, OpenRouter, Google AdMob, Expo, and Sentry. Your use of those services may also be governed by their terms, policies, and platform rules. We are not responsible for outages, policy changes, or separate acts or omissions of those third parties.
9. Intellectual Property and License
Fitty Up, including its software, designs, trademarks, content, and underlying technology, is owned by us or our licensors and is protected by applicable law. We grant you a limited, revocable, non-exclusive, non-transferable license to use Fitty Up for your personal, non-commercial use in accordance with these Terms.
10. Availability, Changes, and Termination
We may update, modify, suspend, or discontinue any part of Fitty Up at any time, including plans, features, AI models, credit rules, or integrations.
- We do not guarantee uninterrupted, secure, or error-free operation.
- We may suspend or terminate access if you violate these Terms, abuse the service, create legal risk, or if we must do so for technical, security, or operational reasons.
- You may stop using Fitty Up at any time and may request account deletion through the app settings.
- When an account is deleted or terminated, access to subscriptions, credits, and stored content may end immediately, subject to limited retention described in our Privacy Policy.
11. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, Fitty Up is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
- We do not guarantee that nutrition estimates, AI outputs, or activity tracking results are accurate or suitable for your needs.
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.
- Our aggregate liability for claims relating to Fitty Up will not exceed the amount you paid to us through Fitty Up in the 12 months before the event giving rise to the claim.
- Nothing in these Terms limits rights that cannot be lawfully excluded under applicable consumer-protection law.
12. Indemnity
You agree to indemnify and hold Fitty Up harmless from claims, losses, liabilities, and expenses arising out of your misuse of Fitty Up, your content, your violation of these Terms, or your violation of another person's rights.
13. Governing Law and Disputes
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. Before filing a formal claim, you agree to contact us first and try in good faith to resolve the dispute informally. If a dispute cannot be resolved informally, the courts of Bangkok, Thailand will have jurisdiction unless applicable consumer law requires otherwise.
14. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may notify you in the app, on our website, or by other reasonable means, and we may require renewed acceptance before continued use of Fitty Up.
